General Terms and Conditions (GTC)

1. Scope

These General Terms and Conditions (GTC) apply to all orders placed via the online shop ownthenight.ch (“Shop”) of Own The Night - Sandra Müller, Goldbrunnenstrasse 157, 8055 Zurich, Switzerland (“Provider”, “we”). By placing an order, the customer (“Customer”) accepts these GTC.

The Shop is exclusively aimed at customers with a delivery address in Switzerland. Orders with a delivery address outside Switzerland cannot be accepted.

2. Contracting Party

The provider within the meaning of these GTC is:

3. Conclusion of Contract

3.1 The presentation of products in the Shop does not constitute a legally binding offer, but an unbinding invitation to order.

3.2 By submitting the order via the checkout process, the Customer makes a binding offer to conclude a purchase agreement. Before the binding submission of the order, the Customer can view all details at any time and correct them using the usual keyboard and mouse functions.

3.3 The purchase agreement is concluded as soon as we accept the order by means of an order confirmation via email, but at the latest upon dispatch of the ordered goods.

3.4 We reserve the right to refuse orders without stating reasons, especially in case of obvious errors in pricing or suspected misuse.

4. Pre-Order

4.1 Products marked in the Shop as “Pre-Order” are items that are not yet ready for dispatch at the time of order.

4.2 The estimated shipping period is indicated on the respective product page and in the order confirmation (currently: from end of September 2026). This is a non-binding timeframe. Delays due to production, international transport, or customs clearance may occur; in such a case, we will inform the customer promptly by email.

4.3 By completing the order, the Customer expressly agrees to the nature of a pre-order and the stated, non-binding delivery date.

4.4 Payment is due and fully collected at the time of the order, regardless of the later shipping date.

5. Prices and Payment Terms

5.1 All stated prices are in Swiss Francs (CHF).

5.2 [If not subject to VAT: The provider is exempt from VAT due to its turnover; therefore, the prices shown do not include VAT.] [If subject to VAT: All prices include the statutory Swiss VAT.]

5.3 The following payment methods are offered: TWINT, credit card (Visa, Mastercard, American Express), and other payment methods displayed at checkout. Payment processing is handled via Shopify Payments.

5.4 The purchase price is due immediately upon completion of the order.

6. Shipping and Delivery

6.1 Delivery is exclusively within Switzerland.

6.2 Shipping costs are shown separately at checkout and are borne entirely by the customer. They are not included in the product price.

6.3 Shipping is carried out by Swiss Post. With the handover of the goods to the transport company, the risk of accidental loss or accidental deterioration of the goods passes to the customer, unless the customer is a consumer within the meaning of Art. 185 para. 3 OR (in which case the provider bears the risk until handover to the customer).

6.4 Stated delivery dates are - unless expressly designated as "binding" - non-binding guidelines, especially for pre-orders (see section 4).

7. Retention of Title

The delivered goods remain the property of the provider until full payment.

8. Returns, Exchanges, and Right of Withdrawal

8.1 Note under Swiss Law: Unlike in the EU, there is no statutory right of withdrawal for online purchase contracts in Switzerland. A purchase in the Shop is therefore generally binding.

8.2 Nevertheless, the provider voluntarily grants the customer the following right of return: The customer can return unused, unworn, and originally packaged goods within 10 days of receipt at their own expense. The refund will be processed to the original payment method after receipt and inspection of the returned goods.

8.3 Returns are only possible if the goods are returned unopened, unworn, and in undamaged original condition with all labels and original packaging. In particular, the following items are excluded from return: - Items whose packaging has been opened - Items that have been worn, put on, used, or otherwise utilized - Items with visible signs of use, wear, or makeup (e.g., makeup, skin, or sweat residues) - Items whose labels have been removed or damaged.

This exclusion serves to protect against returns for hygienic reasons and to ensure that returned goods can be resold in unused condition. The provider reserves the right to refuse obviously used or worn goods upon return and to send them back to the customer or not to issue a refund.

8.4 This voluntary right of return is in addition to the statutory warranty rights (see Section 9) and does not limit them.

9. Warranty / Defect Rights

9.1 The statutory warranty provisions according to the Swiss Code of Obligations (Art. 197 et seq. OR) apply.

9.2 The customer is obliged to inspect the delivered goods immediately upon receipt for obvious defects and to notify the provider of such defects immediately in writing (by email). If no notification is made, the goods are deemed approved, unless it is a hidden defect.

9.3 In the event of justified complaints about defects, the customer is entitled, at the provider's choice, to rectification, replacement delivery, an appropriate reduction in the purchase price, or rescission of the contract.

10. Liability

10.1 The provider is liable without limitation for damages resulting from injury to life, body or health, as well as for damages based on intent or gross negligence.

10.2 For slight negligence, the provider is only liable insofar as essential contractual obligations are violated; in this case, liability is limited to the foreseeable damage typical for the contract.

10.3 Any further liability, in particular for indirect damages or consequential damages, is excluded, as far as legally permissible.

10.4 The provider assumes no liability for delays or delivery failures due to force majeure, events beyond its control (e.g., customs delays, transport failures).

11. Data Protection

Our separate Privacy Policy applies to the processing of personal data.

12. Changes to the GTC

The provider reserves the right to amend these GTC at any time with effect for the future. For contracts already concluded, the GTC valid at the time of the respective order shall apply.

13. Applicable Law and Place of Jurisdiction

13.1 Swiss law shall apply exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

13.2 The place of jurisdiction for any disputes is, as far as legally permissible, [your place of residence/canton].

14. Final Provisions

Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.
